CBP notice to appear for immigrants hit all-time high


AUSTIN, Texas — According to Customs and Border Protection (CBP) data collected and studied by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University, the federal government issued 280,000 Notice to Appear (NTA) documents in the first 10 months of fiscal year 2023.

That’s a massive spike from 95,000 NTAs issued in 2022. Five years ago, in 2018, CBP issued 48,000. 

The last month TRAC collected data, July 2023, was a record month with 44,000 NTAs issued by CBP. 

TRAC collects data, data research and data distribution to better understand detailed information about staffing, spending and law enforcement activities of the federal government.

NTAs place certain migrants and asylum seekers on immigration court removal proceedings. The university’s research shows NTAs were rarely used at ports of entry until the Biden administration. The data was collected from the Office of Field Operations (OFO), which is a separate agency designed to process people at ports of entry.

Noncitizens attempting to enter the United States may be found inadmissible for a range of reasons. Inadmissibility findings do not necessarily conclude certain individuals will not be allowed into the country temporarily.

TRAC research found the numbers are not only driven by an increase in migrants arriving at ports of entry. 

According to TRAC findings, perhaps more than 30,175 immigrants who paroled into the country in July could be issued an NTA at a later date.

Five of the top eight ports of entry logging NTAs are in Texas, including Brownsville, Hidalgo, El Paso, Eagle Pass and Laredo. 

San Ysidro, California, and Brownsville make up about one-quarter of all NTAs. 

Note: CBP data from October 2020 to June 2022 is missing in those 21 months.
